§ 42-71. Determination and declaration of necessity; notification of owner(s) to build, rebuild or repair.

  • Whenever the city commission shall deem the building, rebuilding or repairing of any sidewalk or sidewalks in the city to be a public necessity, the city commission shall, by resolution, determine and declare the necessity therefor and specify the character of the improvement to be made and shall by such resolution direct the city clerk to notify the owner, owners or occupants of the abutting land to build, rebuild or repair, as the case may be, that portion or portions of such sidewalk or sidewalks adjacent to his or their property within 30 days from the service upon him, or them, of such notice.
