§ 58-24. Sewer charge for users outside the city.

  • At such time as the city commission shall permit nonresidents of the city to connect to the sanitary sewer system of the city the following conditions and charges will be prerequisites to the granting of such consent:

    (a)

    A sewer charge made up of a combination of an initial sewer connection charge and a continuing sewer service charge shall be made for sewage service rendered directly or indirectly through the City of Parchment sewer system to any property which is located outside the City of Parchment and for which a connection to an existing sanitary sewer operated by the City of Parchment has been or is to be made.

    (b)

    An initial sewer connection charge of $300.00 shall be collected for each single family dwelling unit or part thereof, which charge is to be paid upon application for connection and in advance of any construction. For any installation other than dwelling units the charge will be based on dwelling unit equivalents each of which is considered to be 350 gallons of sewage per day discharged to the sewer system.

    (c)

    The number of dwelling unit equivalents involved in computing the sewer connection charge shall be determined by dividing the average metered daily water consumption (converted into gallons) by the 350 gallons per day figure.

    (d)

    An additional initial fee sufficient to cover the cost of city inspection of all sewer construction necessary to the making of an approved connection may also be collected at the time that the permit authorizing the connection is issued.

    (e)

    In addition to the initial service connection charge, it shall be the responsibility of the owner of the property to be served to bear all costs involved in the construction of all sewers and other sewage connections necessary to deliver the wastes from the sewered property to a point of connection to be determined and designated by the City of Parchment. The construction of all such connecting sewers between the building to be sewered and the point of connection to the City of Parchment sewer system is to be carried out in accordance with the applicable provisions of section 58-41 et seq., of this chapter and with plans and specifications which have received the written prior approval of the designated representative of the City of Parchment. This approval is to supplement and not supercede any other permits or approvals required by other governmental agencies.

    (f)

    In the cases of property lying outside the City of Parchment adjoining a right-of-way which constitutes a portion of the city limits and on which a city-owned sewer exists at the time of the connection of said property to the existing sewer the property owner shall be assessed as an additional initial charge a fair share of the actual construction costs of the existing sewer based on his benefited frontage.

    (g)

    If any building located outside of the City of Parchment and discharging sewage into the sewer system of the City of Parchment shall be using water obtained from any source other than the City of Parchment, a meter owned and maintained by the city shall be installed thereon at the expense of the owner of the building and the cost of this meter and its installation shall be billed at actual correct cost; provided said meter required may be waived if the water is adequately metered in the opinion of the City of Parchment. The city shall be given access to said meter at all reasonable times in order to determine the water usage.

    (h)

    A continuing sewer service charge at the rate of $0.15 per 100 cubic feet of water used shall be collected quarterly for each connection. This rate shall be reviewed annually and adjusted so as to assure the City of Parchment an income from outside services which will return the cost of treatment plus a minimum of 25 percent. In addition to this sewer service charge a continuing fixed quarterly charge shall be collected based upon the size of the installed water meter and shall be as follows:

    Users whose normal consumption of water is less than 10,000 cubic feet during the winter quarter and who use water for lawn sprinkling will be billed each quarter on the basis of the winter consumption. Other users will be billed on the basis of water used each quarter.

    (i)

    The amount due for sewage service hereinabove specified shall be collected in the same manner and all means of collection as set forth in section 58-111 et seq., in reference to water accounts shall be applicable thereto. The owners of buildings located outside of the City of Parchment and using the sewer system of the City of Parchment shall be billed quarterly for the service as hereinabove provided. In the event of failure to pay for said service, the City of Parchment may, in its corporate name, file suit against said owner in any court of competent jurisdiction and the production of the meter record and/or cost record shall be prima facie evidence of the amount therein shown to be due.

    (j)

    Before a sewer connection shall be made for property located outside the City of Parchment, the owner of said property shall agree in writing to abide by the provisions of sections 58-41 et seq., and will further agree that in the event said Ordinances are violated by the persons so signing or any subsequent owner or user of the sewer service located on the premises involved that said violation of the provisions of the Ordinances shall constitute just cause for terminating services to said premises.

    The above provisions shall not apply to persons residing outside the City of Parchment and connected to the Parchment city sewer system when said connection is made in accordance with an agreement entered into by and between the City of Parchment and another municipal corporation.
