§ 54-81. Definitions.

  • The following definitions shall apply to this division:

    Emergency response shall mean:

    (1)

    The providing or sending of city emergency services including, but not limited to, police, fire, rescue, ambulance or public service personnel and equipment to the scene of a personal injury or property damage accident within the city limits arising from or involving a motor vehicle where one or more of the operators thereof operated a motor vehicle while under the influence of intoxicating liquor or controlled substances, or a combination thereof or with his or her ability to operate the motor vehicle visibly impaired due to intoxicating liquor or controlled substances or a combination thereof or with a blood alcohol level equal to or in excess of 0.07 percent by weight of alcohol.

    (2)

    An arrest within the city limits by a police or public service officer of an operator of a motor vehicle who was operating a motor vehicle while under the influence of intoxicating liquor or controlled substances or a combination thereof or with his or her ability to operate the motor vehicle visibly impaired by intoxicating liquor, controlled substances or a combination thereof or with a blood alcohol level equal to or in excess of 0.07 percent by weight of alcohol.

    Expense of an emergency response shall mean: all direct costs incurred by the city for providing emergency response as defined in this division including, but not limited to, the following:

    (1)

    The direct costs to the city for having its police or public service officers respond to the emergency.

    (2)

    The costs of chemical rights tests incurred, including, but not limited to, blood, breathalyzer, and intoximeter tests.

    (3)

    The direct costs of having public service, police, fire fighting, rescue and ambulance services to respond to the emergency.

    (4)

    Mileage incurred by a city vehicle in responding to the emergency.
