§ 38-71. Definitions.

  • The following defined terms shall apply to this article:

    Bulky waste: Stoves, refrigerators, water tanks, washing machines, furniture and other large and bulky refuse unable to be containerized or lifted by one person.

    City refuse tag: A tag, sticker or label approved and sold by the City of Parchment or an authorized agent thereof permitting removal of the item to which it is affixed during rubbish pickup.

    Commercial waste: Waste arising from the operation of a business or commercial enterprise including, but not limited to, multifamily residences of four or more dwelling units, stores, churches, schools, or similar enterprises.

    Dwelling unit: A building, or a portion thereof, designed for and having occupancy by one family for residential purposes.

    Garbage: All putrescible and nonputrescible animal, fruit or vegetable waste intended for or resulting from the handling, preparation, cooking and consumption of food together with small refuse to which garbage is adhered.

    Hazardous waste: Waste likely to contaminate and pollute soil or water or likely to cause or significantly contribute to mortality or illness if improperly treated, stored, transported, disposed of or otherwise managed including, but not limited to, paint, solvents, household cleaners, lawn and garden chemicals, pesticides, paint thinners, acids, alkalies, aerosols, chemicals, kerosene, antifreeze, explosives, asbestos, and radioactive materials. Hazardous waste shall also include "hazardous substances", including, but not limited to:

    (a)

    Any substance designated pursuant to section 311(b)(2)(A) of the Federal Water Pollution Control Act (33 USCS subsection 1321(b)(2)(A));

    (b)

    Any element, compound, mixture, solution or substance designated pursuant to section 102 of this Act (42 USCS subsection 9602);

    (c)

    Any hazardous waste having the characteristics identified under or listed pursuant to section 3001 of the Solid Waste Disposal Act (42 USCS subsection 6921), but not including any waste the regulation of which under the Solid Waste Disposal Act has been suspended by Act of Congress;

    (d)

    Any toxic pollutant listed under section 308(a) of the Federal Water Pollution Control Act (33 USCS subsection 1317(a);

    (e)

    Any hazardous air pollutant listed under section 112 of the Clean Air Act (42 USCS subsection 7412); and

    (f)

    Any imminently hazardous chemical substance or mixture with respect to which the administrator has taken action pursuant to section 7 of the Toxic Substances Control Act (15 USCS subsection 2606). The term does not include listed or designated as a hazardous substance under subparagraph (a) through (f) of this paragraph and the term does not include natural gas, natural gas liquids, liquified natural gas or synthetic gas usable for fuel (or mixtures of natural gas and such synthetic gas).

    Industrial waste: All waste resulting from industrial, manufacturing or processing operations.

    Person: Any individual, partnership, corporation, group or organization.

    Residence: A parcel of land upon which is located single-family homes or structures containing four or less dwelling units.

    Rubbish: All nonputrescible solid waste consisting of both combustible and noncombustible material including, but not limited to, paper, cardboard, boxboard, tin cans, wood, glass, metal, bedding, clothing and similar small materials residentially generated. Rubbish does not include any bulky waste, commercial waste, garbage, hazardous waste, industrial waste and yard waste as defined herein.

    Trimmings: The pieces cut off in trimming, clipping, paring or pruning trees, shrubs or brush, provided that the diameter thereof does not exceed four inches at any point.

    Yard waste: Grass clippings, leaves and trimmings.
