§ 30-23. Curfew.

  • (a)

    No person under the age of 17 years shall be or remain in or upon any of the streets, alleys or public places in the city after the hour of 10:00 p.m. and until 5:00 a.m. the next day unless he is accompanied by his parent, guardian or other person having custody and control of such minor, or unless he is in the performance of an errand so directed by his parent, guardian or such other person, or where the employment of such minor makes it necessary for him to be upon the streets, alleys or public places during the night time within the hours specified.

    (b)

    No parent, guardian or other person having the legal care of any minor under the age of 17 years shall permit or allow such minor while in his legal custody to go and be unaccompanied upon any of the streets, alleys, and public places of the city within the time specified in the preceding section unless there exists a reasonable necessity therefor.

    (c)

    The city police are hereby authorized to question and detain children and inform their parents or guardian, advising said parents or guardian of any violation of these curfew provisions by their child, children or ward.

    (d)

    These curfew provisions herewith shall not apply to any such minor in attendance at an official school, church or other adult-supervised function, including one hour to return home from said function.
