§ 18-41. Finding of necessity.

  • The city commission adopts this article on the following determinations made by it:

    (1)

    That gasoline filling stations and service stations may, if unregulated, constitute a hazard to vehicular and pedestrian traffic.

    (2)

    The erection and operation of such stations in too close proximity to churches, schools, hospitals and other such institutions where large numbers of pedestrians congregate, without regard to the public convenience, is detrimental to the general health, welfare and safety of the people of the city.

    (3)

    That the too close proximity of such stations to residential areas can cause noise, odor, lights, fumes, vibrations, danger of fire and explosions which, if unregulated, can constitute a nuisance and a detriment to the general health, welfare and safety of the people of the city.

    (4)

    That the erection and operation of such stations without regulation and control endangers the public safety and retards the general welfare.

    (5)

    That section 1, of the City Charter gives the city the power pursuant to the authority conferred by the provisions of section 4(i) of Act 279, Public Acts of 1909, as amended (M.S.A. § 5.2082) "for regulating and restricting locations of oil and gasoline stations."
